Terms of Service
These terms cover the relationship between you and Phantom — what we provide, what we expect, and what happens if things go wrong.
Effective April 30, 2026
1. Accepting these terms
By adding the Phantom bot ("Phantom") to a Discord server, signing in to the Phantom dashboard, or otherwise using any part of the service, you agree to these Terms of Service ("Terms"). If you're agreeing on behalf of an organisation, server, or community, you confirm you have authority to bind that group to these Terms.
If you don't agree with these Terms, don't add the bot, don't open the dashboard, and remove Phantom from any server where you've added it.
2. Changes to these terms
We may update these Terms from time to time. When we make a material change, we'll post the new version at this URL with an updated "Effective" date and, where we can, give at least 14 days' notice through the Phantom support server, an email, or a dashboard banner. Continuing to use Phantom after the new Terms take effect means you accept them; if you don't, stop using the service before the effective date.
3. Who can use Phantom
Phantom is a service for Discord users and the servers they run. To use it you must:
- Be at least 13 years old, or whatever higher age Discord requires in your country (Discord enforces a 13+ minimum globally and stricter limits in some countries — see Discord's Terms of Service).
- Have the legal capacity to enter into a binding contract in your jurisdiction.
- Not be barred from using the service under applicable law (including export-control or sanctions law).
If you're using Phantom on behalf of a server, you must have the Manage Server permission or equivalent authority to add bots and configure their behaviour.
4. Your account
You sign in to the Phantom dashboard using your Discord account through Discord's OAuth2 flow. You're responsible for keeping your Discord credentials secure; we treat anyone signed in with your Discord account as you. If you suspect unauthorised use, sign out from every device, revoke Phantom's access in Discord's Authorized Apps settings, and contact us.
The information we receive from Discord during sign-in is described in the Privacy Policy.
5. The service
Phantom is a Discord bot and accompanying dashboard offering moderation, automod, logging, welcome messages, levelling, tickets, giveaways, suggestions, reviews, custom commands, and other community-management features. We add and remove modules over time. Some modules are subject to feature flags or paid tiers as described in Section 11.
We don't guarantee uninterrupted availability. We perform maintenance, push updates, and depend on Discord's platform — outages happen. We aim to communicate planned downtime through the support server and the public status page.
6. Acceptable use
You agree to use Phantom only as permitted by these Terms and our Acceptable Use Policy. The Acceptable Use Policy is incorporated into these Terms by reference; violating it is a violation of these Terms.
7. Your content
"Your Content" means anything you input or generate through Phantom — moderation reasons, custom command text, embed builder layouts, ticket transcripts, welcome message templates, dashboard configuration, uploaded background images, and the messages members of your server send that Phantom processes (for example, automod-flagged messages or messages that trigger logging).
You retain ownership of Your Content. We don't claim copyright in your configurations or your members' messages.
You grant Phantom a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display, and process Your Content for the limited purpose of operating the service for you — including caching, replicating across our infrastructure, generating analytics that don't identify individuals, and surfacing the content back to authorised users (you, your moderators, the people in your server).
You're responsible for Your Content. You represent that you have all rights necessary to upload it, that it doesn't infringe anyone's rights, and that it complies with the Acceptable Use Policy and Content Safety Policy.
8. Licence we grant you
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Phantom in your Discord servers and access the dashboard, for the duration of your use. You may not sublicense, resell, or otherwise commercialise our service except where we explicitly allow it (for example, the Custom Branding feature in Section 10).
9. Intellectual property
The Phantom name, logo, dashboard design, marketing copy, and software (including the bot, the web application, the legal pages you're reading right now, and our public APIs) are owned by us or our licensors and protected by copyright, trademark, and other laws. We grant you the licence in Section 8 and nothing more.
You may not copy, modify, distribute, sell, lease, decompile, or reverse-engineer any part of the service except where applicable law explicitly permits it. You may not remove or obscure copyright or other proprietary notices on the service. You may not scrape, frame, or otherwise systematically extract content from the service except through our published APIs and within the rate limits we publish.
10. Custom Branding
Custom Branding is the feature that lets you bring your own Discord bot application and have Phantom power it under your name and avatar. When you use Custom Branding:
- You must own or be authorised to administer the Discord application whose token you provide.
- You're responsible for the conduct of your bot. Even though Phantom provides the runtime, the bot acts under your application identity, and Discord, your members, and the public will treat actions it takes in your server as actions taken by you.
- You agree to comply with Discord's Developer Terms of Service and Developer Policy, which govern what bots may do on the platform. We pass those obligations down to you because the bot is operating under your application.
- You're responsible for providing your own Privacy Policy, Terms of Service, and any other notices Discord requires for verified or large bots — your application is your own product.
- We may suspend Custom Branding for any application that breaches these Terms, the Acceptable Use Policy, or the Content Safety Policy — including by disconnecting it from your server.
- Bot tokens you provide are encrypted at rest and used only to operate your bot through Phantom. We never display them back to you and only decrypt them in-process during operation.
11. Paid services and billing
Some Phantom features may be offered on a paid basis. When that's the case, the dashboard will clearly mark the feature as paid before you commit to a plan. Phantom is in early access at the time these Terms became effective, and most features are free; if and when paid plans are introduced:
- Pricing, billing cycle, and the included features will be displayed at checkout. By starting a subscription you agree to the price shown.
- Subscriptions auto-renew at the end of each billing cycle unless you cancel before the renewal date. You can cancel from the dashboard at any time.
- Refunds are issued at our discretion for genuine billing errors or where required by law. We don't generally pro-rate refunds for partial billing periods.
- If your payment fails, we may suspend the paid features until payment is resolved. Free features remain available.
- Taxes and fees are your responsibility unless required by law to be collected by us.
12. Discord and other third parties
Phantom runs on top of Discord. You also need a Discord account, and you must comply with Discord's Terms of Service, Community Guidelines, and Developer Terms when applicable. Discord may suspend, restrict, or remove our bot at its sole discretion; if that happens, Phantom may stop working in your server through no fault of ours.
We rely on a number of subprocessors to deliver the service — see Subprocessors. Their availability and policies affect ours; we choose them carefully but we don't control them.
13. Suspension and termination
You may stop using Phantom at any time. Removing the bot from your server, signing out of the dashboard, and (if applicable) cancelling your subscription is enough to end your use of the service. Some data may be retained as described in the Privacy Policy.
We may suspend or terminate your access — partly or in full, with or without notice — if:
- You materially breach these Terms or any policy incorporated into them.
- Continuing to provide the service would create legal risk for us.
- Discord requires us to.
- You submit a chargeback for a paid plan and don't resolve it through us first.
- Your account has been inactive for a long period and we need to reclaim resources.
Termination doesn't relieve you of any obligation that by its nature should survive — payments owed, indemnities, IP, governing law, and the disclaimers and liability caps below.
14. Disclaimers
Phantom is provided "as is" and "as available", without warranties of any kind, express or implied, except where applicable law disallows that. We don't warrant that the service will be uninterrupted, error-free, secure against every conceivable threat, or fit for any particular purpose. We don't warrant the accuracy of moderation outcomes, automod decisions, scheduled actions, log entries, or any other automated function. Use Phantom as part of a moderation strategy, not as a replacement for human judgment.
15. Limitation of liability
To the maximum extent permitted by law, Phantom and its operators, contributors, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost goodwill, or any damages over and above the amount you actually paid us in the 12 months preceding the event giving rise to the claim. If you didn't pay us anything, our total aggregate liability to you is capped at one hundred US dollars (USD 100).
Some jurisdictions don't allow limits on certain types of liability. Where that applies, our liability is limited to the smallest extent permitted by your local law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Phantom and its operators from any claim, demand, damage, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the service, (c) your violation of these Terms or any policy incorporated into them, or (d) your violation of any third-party right, including any Discord rule, intellectual-property right, or privacy right.
17. Governing law and disputes
These Terms are governed by the laws of the operator's principal place of business, without regard to conflict-of-laws principles. Disputes that can't be resolved by good-faith discussion will be brought in the courts of that jurisdiction, and you and we consent to their exclusive jurisdiction. Where mandatory consumer-protection rules in your jurisdiction grant you stronger rights, those rules prevail to the extent they're mandatory.
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of our right to enforce it later.
